It's a different game, technically. Just because you paid for Halo3 doesn't mean you get Halo ODST free.

Being a software developer myself I completely understand that the new version costs something. Developing a new version of the game, not just applying bug fix patches to the current version, required time, probably quite a bit of time from their programmers. The cost of that time must be covered, hence a small price for FC2.
